Camera Van
« on: May 05, 2018, 07:53:43 pm »
Riding home from work yesterday I went through Hawarden towards an area known locally as "Tinkersdale", as you're leaving the village it's downhill and there's occasionally a camera van there to scoop up those who've allowed their vehicle to pick up speed. Being honest there's no houses there just a poorly used car park. The camera vans in north Wales are run by a private firm I believe.

Yesterday the camera van was there but I paid it little heed as I knew I was within the 30 limit.

This morning when I logged onto Facebook, I was surprised to see the van, it appears someone checked its plates and its MoT expired in February  :D

Someone needs to do the right thing here and report it.  8)

No MOT and therefore the insurance is invalid.

Definitely should be reported but insurance comment is wrong.

Not according to this article https://www.thinkmoney.co.uk/news-advice/is-car-insurance-valid-without-mot-0-5903-0.htm although I think it would depend upon the terms of your insurance. Maintaining a roadworthy vehicle comes to mind.
Its not always the destination that counts its the ride, having a destination just stops you going round in circles.

DVLA will take no action!

A friend's neighbour buys, sells and breaks cars. They are scattered all over the roads of west Swindon. None have insurance or Tax and most no MoT.

The police say it isn't down to them even if their ANPR car pings it they won't take action unless it is being driven.

The local authority, who the police say are responsible, don't know the difference between a car parked illegally on the highway (which none of his are) and an illegal car parked legally on the highway (which all of his are) so they don't do anything.

DVLA can't be arsed. It has to be the same car parked in the same place at the same time all the time otherwise the chances of their meandering van stumbling across it are negligible.

Four years of trying and not one single hit.

Oh, did I mention he is an RAC patrol man?

Yes, seems no-one gives a shit.

Had it been a biker dropped a sweetie wrapper - it would have been the full SWAT team and multiple police helicopters dispatched with vengeance!

I am afraid the insurance comment is most definitely correct. If insurers pay a claim (which they will have to do for personal injury) arising from an incident involving a vehicle without a current MOT they will pursue their policyholder for full recompense of their outlays.

Firstly, as you say, the insurance company will pay so vehicle/driver is insured! As a third party seeking payment for  damages/injuries, your cheque will come from the insurance company meaning the driver was insured.

Only if the lack of MoT was directly contributory to the claim will the insurance company have the option of seeking damages from the insured for breach of contractual terms and then they'll only do that if you have enough worth going after.

You can not be prosecuted for driving with no insurance if you hold a current policy but are driving a vehicle with no current MoT because you're insured!

When does your MOT expire and will you bother renewing it? Will you also bother renewing your motor insurance?
